Article 1 — Introduction and Scope

I. Privacy Policy. This Privacy Policy describes how LGCY A.R.P., Inc (“LGCY,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise handles personal information in connection with the website and related pages, content, features, and materials that we make available (the “Site”), which is operated by LGCY.

II. Site use. The Site is currently intended for informational, promotional, advertising, and business inquiry purposes; for access to certain informational materials; and for displaying or facilitating access to LGCY’s separate Master Terms of Service or related order forms. LGCY’s advisory and consulting services are governed by a separate services agreement, and use of the Site, submission of information through the Site, or viewing of any presentation does not create a client, advisory, fiduciary, or contractual services relationship with LGCY. Your use of the Site is subject to our Website Terms of Use (lgcy-arp.com/terms-of-use) (which incorporates this Privacy Policy in its entirety by reference), including its governing law and dispute resolution provisions.

III. Information governed by a services agreement. This Privacy Policy does not govern information that LGCY receives, accesses, or processes in performing services for a client under a services agreement, including client materials and other information provided in the course of an engagement. That information is governed by the applicable services agreement, which controls in the event of any conflict with this Privacy Policy.

IV. No client accounts. The Site is not currently intended to provide paying clients with accounts, dashboards, portals, document rooms, or platform-based access to LGCY’s services. After a services relationship is formed, client interactions are expected to occur directly through email, live conversations, telephone, videoconference, or similar direct communications, unless LGCY later states otherwise in an updated policy or separate agreement.

V. Who may use the Site. The Site is intended for business owners and professionals and is not directed to children. You must be at least 18 years old, or the age of majority where you live, to use the Site.

VI. Changes to this Privacy Policy. We may update this Privacy Policy from time to time. The “Last Updated” date above indicates when this Privacy Policy was last revised. Any changes will become effective when posted or otherwise made available, unless we state otherwise.

Article 2 — Personal Information We Collect

I. Information you provide to us. We may collect personal information that you choose to provide through the Site or related communications, including when you contact us, request information, submit an inquiry, request or schedule a call, request access to materials, provide information in connection with a potential engagement, or interact with forms made available through the Site. This information may include:

A. Contact information. Name, business name, title or role, email address, telephone number, mailing address, business address, and similar identifiers.

B. Business inquiry information. Information about your business, industry, ownership or management role, exit-planning objectives, anticipated timing, interest in LGCY’s services, and other information you include in a message or inquiry.

C. Scheduling and communications information. Information submitted through booking, scheduling, email, or similar communication tools, including meeting preferences and communication history.

D. Access information. If LGCY provides access codes or gated materials, we may collect information associated with providing, administering, disabling, or verifying access to those materials. Certain LGCY presentations may be made available only through access codes provided by LGCY.

E. Pre-call scheduling information. If you schedule a call through the Calendly booking link embedded on the Site, you may be asked to answer questions before the call, which may include your company name, information about your company’s personnel, your title, and your business’s revenue and profit ranges. This information is used as described in Article 3.

F. Agreement-related information. If the Site is used to present or facilitate acceptance of LGCY’s Master Terms of Service, an order form, or related documents, we may collect information associated with that process, such as name, business name, email address, date and time of action, version of terms presented, IP address, and other acceptance or acknowledgment records, as applicable. LGCY’s services are governed separately from Site use.

G. Payment information. Payments for LGCY's services are made through HubSpot and processed by Stripe, not through the Site; payment information is collected directly by those providers under their own privacy policies and is otherwise governed by the applicable services agreement.

II. Information collected automatically. When you visit or interact with the Site, we and our service providers may automatically collect certain technical and usage information, including:

A. Device and browser information. IP address, browser type, operating system, device type, device identifiers, and similar technical information.

B. Usage information. Pages viewed, referring and exit pages, dates and times of visits, time spent on pages, click activity, and other information regarding interaction with the Site.

C. Approximate location information. General location inferred from IP address or similar technical information.

D. Cookies and similar technologies. Information collected through cookies, pixels, tags, local storage, analytics tools, embedded content, or similar technologies. Current cookie, analytics, and tracking tools include Google Analytics and HubSpot analytics (on pages hosted by HubSpot) and may include additional tools that LGCY implements in the future.

III. Information from third parties. We may receive personal information from third parties, including referral sources, professional advisors, business partners, marketing vendors, service providers, publicly available sources, or other persons who communicate with us about a potential engagement. The Site currently uses or may integrate with third-party applications and services such as Calendly, HubSpot, Vercel, Supabase, MailChimp, and Google Analytics, some of which may collect information directly when you interact with their tools or features. LGCY may add or change third-party applications and services in the future.

IV. Information you should not submit through the Site. Unless we specifically request it, you should not submit sensitive personal information through the Site, including Social Security numbers, government identification numbers, financial account numbers, payment card information (other than through a payment processor described in Article 2.I.G), tax identification numbers, health information, precise geolocation information, biometric information, account passwords, or other highly sensitive information. Information submitted through the Site is not treated as confidential except as described in this Privacy Policy or in a separate written agreement signed or accepted by LGCY.

Article 3 — How We Use Personal Information

I. Business and operational purposes. We may use personal information for the following purposes:

A. Responding to inquiries. To respond to contact requests, questions, consultation requests, scheduling requests, and other inquiries.

B. Evaluating potential engagements. To understand your business needs, evaluate whether LGCY’s services may be a fit, prepare follow-up communications, and support discussions regarding a potential services engagement.

C. Providing Site content. To provide, operate, maintain, secure, and improve the Site and its content, including informational and marketing materials.

D. Administering access. To provide, manage, monitor, disable, or revoke access codes and gated materials, including presentations and other confidential or proprietary materials made available by LGCY.

E. Marketing and communications. To send informational, promotional, or marketing communications, newsletters, updates, invitations, or similar communications, subject to applicable law and any available opt-out choices.

F. Analytics and improvement. To understand Site traffic, usage, engagement, and performance; improve content and functionality; and assess marketing effectiveness.

G. Security and misuse prevention. To detect, investigate, prevent, or respond to misuse, security incidents, unlawful conduct, unauthorized access, fraud, or violations of applicable terms.

H. Legal and compliance purposes. To comply with legal obligations, preserve records, enforce agreements and terms, protect rights and safety, cooperate with lawful requests, and establish, exercise, or defend legal claims.

II. Aggregated and de-identified information. We may create and use aggregated, anonymized, or de-identified information for business, analytical, operational, and marketing purposes, provided that such information is not intended to identify you.

Article 4 — Cookies, Analytics, and Similar Technologies

I. Use of technologies. We may use cookies and similar technologies to operate the Site, remember preferences, understand usage, measure performance, support security, and conduct analytics and non-targeted marketing activities.

II. Types of technologies. These technologies may include browser cookies, pixels, tags, local storage, analytics scripts, embedded third-party content, scheduling tools, video tools, and similar technologies. The Site currently uses Google Analytics and HubSpot analytics (on pages hosted by HubSpot) and may use additional cookie, analytics, or tracking technologies that LGCY implements or becomes aware of in the future. Certain third-party tools integrated with the Site, such as HubSpot, Calendly, and Mailchimp, may also set cookies or use similar technologies on pages where they are embedded or when you interact with their features. If you submit a form or otherwise identify yourself to us, information collected through these technologies, such as pages you previously visited on the Site, may be associated with the contact information you provide.

III. Google Analytics and HubSpot analytics; activity across websites. Google Analytics collects information about your use of the Site, such as pages visited and time spent on pages, using cookies and similar technologies. Third parties, including Google, may collect information about your online activities over time and across different websites when you use the Site. For information about how Google uses data from sites that use its services, visit policies.google.com/technologies/partner-sites. HubSpot also collects information about visits to the pages it hosts for LGCY (currently at insights.lgcy-arp.com, including our blog pages), such as pages visited and time spent on pages, using cookies and similar technologies.

IV. Your choices. You may be able to manage cookies through your browser settings or through any cookie preference tool we make available. If LGCY implements a cookie banner, cookie preference center, or similar mechanism, details will be provided through that tool or otherwise made available on the Site.

V. Do Not Track and preference signals. Certain browsers or devices may allow you to transmit “Do Not Track” or other preference signals. The Site does not currently respond to “Do Not Track” signals, but LGCY will process legally required opt-out or preference signals to the extent required by applicable law.

Article 5 — How We Disclose Personal Information

I. Service providers and vendors. We may disclose personal information to vendors and service providers that perform services for us, including website hosting, website development and maintenance, form management, email delivery, customer relationship management, scheduling, analytics, marketing, data storage, security, legal document acceptance, and other operational support. Current relevant vendors and third-party services include Calendly, HubSpot, Vercel, Supabase, MailChimp, and Google Analytics. The information collected or shared with these providers depends on how you use the Site and may occur when you interact with or opt in to newsletters, waitlists, scheduling tools, forms, analytics tools, or similar Site features. LGCY may add, remove, or change vendors and third-party services in the future.

II. Professional advisors. We may disclose personal information to attorneys, accountants, consultants, insurers, auditors, and other professional advisors.

III. Referral sources and business contacts. If you are referred to LGCY by a third party or if a third party is involved in communications regarding a potential engagement, we may disclose limited information as reasonably appropriate in connection with that relationship, subject to applicable law and any confidentiality obligations.

IV. Affiliates and business transaction parties. We may disclose personal information to affiliates, related entities, successors, assigns, or parties involved in a potential merger, reorganization, financing, sale of assets, acquisition, or similar business transaction.

V. Legal, security, and rights-protection disclosures. We may disclose personal information if we believe disclosure is necessary or appropriate to comply with law, respond to lawful requests, protect the Site, enforce applicable terms or agreements, protect the rights, property, or safety of LGCY or others, or investigate potential violations, misuse, fraud, or security incidents. LGCY may cooperate with law-enforcement or regulatory authorities in connection with Site misuse or enforcement matters.

VI. Third-party links and resources. The Site may link to third-party websites or resources. LGCY does not control and is not responsible for third-party websites, resources, or privacy practices, and your use of third-party resources is subject to their own terms and policies.

VII. Sale or sharing of personal information. LGCY does not sell personal information for money and does not currently disclose or share personal information with a third party in exchange for monetary or other valuable consideration. LGCY does not currently use personal information collected through the Site for targeted advertising, cross-context behavioral advertising, or retargeting. If LGCY changes these practices in the future, it will provide any notices, choices, and opt-out rights required by applicable law.

Article 6 — Marketing Communications

I. Marketing communications. We may use contact information to send you marketing, promotional, educational, or informational communications regarding LGCY, the Site, or LGCY’s services.

II. Opt-out. You may opt out of receiving marketing emails by following the unsubscribe instructions included in those emails or by contacting us at info@lgcy-arp.com. Even if you opt out of marketing communications, we may continue to send non-marketing communications, including responses to inquiries, scheduling communications, transactional communications, legal notices, and communications regarding an existing or potential services relationship.

Article 7 — Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law, contract, dispute-resolution needs, audit requirements, security needs, or legitimate business purposes.

Article 8 — Security

I. Safeguards. We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, considering the nature of the information, the purposes for processing it, and the risks associated with unauthorized access, disclosure, alteration, or destruction.

II. No guarantee. No website, system, transmission, or storage method is completely secure. We therefore cannot guarantee absolute security of personal information.

III. Access controls. Access to personal information is intended to be limited to personnel, vendors, and advisors who have a business or legal need to access it and who are subject to appropriate confidentiality, contractual, or professional obligations.

Article 9 — Your Choices and Privacy Requests

III. Verification. We may take reasonable steps to verify your identity and authority before responding to a privacy request, which may include asking you to provide information sufficient to confirm that you are the person about whom the request relates or that you are authorized to act on that person’s behalf.

IV. Authorized agents. If applicable law permits you to use an authorized agent to submit a request, we may require proof of the agent’s authority and may also require you to verify your identity directly with us.

V. Appeals. If applicable law provides an appeal right and we deny your request, you may appeal by contacting us at info@lgcy-arp.com.

Article 10 — Additional State Privacy Notices

I. State-specific rights. Certain U.S. state privacy laws may provide residents of those states with additional rights regarding personal information. Whether those laws apply to LGCY may depend on LGCY’s operations, revenue, volume of personal information processed, advertising practices, and other factors.

II. Current state-law status. LGCY will provide state-specific privacy notices, rights, and opt-out mechanisms if and to the extent required by applicable state privacy law based on LGCY’s operations, processing activities, and legal obligations.

III. Categories of personal information. To the extent required by applicable state privacy law, LGCY’s disclosures regarding categories of personal information collected, purposes of use, and categories of recipients are reflected in Article 2, Article 3, and Article 5 of this Privacy Policy.

IV. Sensitive personal information. LGCY does not intend for the Site to collect sensitive personal information unless expressly requested by LGCY for a specific purpose. If sensitive personal information is submitted despite this instruction, LGCY may handle it as reasonably necessary for the purpose for which it was submitted, to delete or restrict it, to comply with law, or to protect LGCY’s rights and systems.

V. State-law opt-outs. LGCY does not currently sell personal information for money, disclose or share personal information with a third party in exchange for monetary or other valuable consideration, or use personal information collected through the Site for targeted advertising, cross-context behavioral advertising, or retargeting. If LGCY changes these practices in the future, it will provide any notices and opt-out rights required by applicable law.

VI. Non-discrimination. LGCY will not unlawfully discriminate against you for exercising privacy rights available under applicable law.

Article 11 — International Users

I. United States focus. The Site is intended for users located in the United States. If you access the Site from outside the United States, you understand that personal information may be processed in the United States, where privacy laws may differ from those in your jurisdiction.

II. International operations. If LGCY receives inquiries from persons located outside the United States or uses vendors or service providers located outside the United States, personal information may be transferred to, processed in, or accessed from jurisdictions that may have privacy laws different from those in your location, subject to applicable law and contractual or operational safeguards where appropriate.

Article 12 — Children’s Privacy

I. Not directed to children. The Site is intended for adults and business professionals and is not directed to children or other minors.

II. No knowing collection. We do not knowingly collect personal information from anyone under 18 years of age. If we learn that a minor has provided personal information through the Site, we will take reasonable steps to delete it or otherwise handle it in accordance with applicable law.

Article 13 — Third-Party Content and External Resources

I. External resources. The Site may contain links to or integrations with third-party websites, tools, resources, scheduling services, video services, social media features, or other third-party content. LGCY does not control third-party privacy practices and is not responsible for third-party websites or resources.

II. Third-party collection. Third parties may collect information directly from you or your device when you interact with third-party content or tools. Their collection and use of information are governed by their own privacy practices, not this Privacy Policy.
